A presente pesquisa tem por objetivo geral identificar a relação do Estatuto da Criança e do Adolescente com o professor, e os reflexos na formação e atuação dele, para o efetivo cumprimento de seu papel de educador, em busca da construção da cidadania das crianças e dos adolescentes. Para atingir tal desiderato, partiu-se da análise do direito à educação nas Constituições Federais e nas principais leis que trataram do direito da criança e do adolescente, a fim de verificar a coerência entre a lei e a atuação do professor. The purpose of this research is to identify the relationship of the Statute of child and the adolescent (a brazilian law about rights and duties of children and adolescents) with the teacher, and its reflection on his/her training and practice, aiming the effective accomplishment of his/her role of educator. To achieve this, our departure was the analysis of the right to education in the Federal Constitutions and in the main laws which have dealt with rights of children and adolescents, in order to verify if this relationship between the law and the teacher was justified.
